PRIVACY POLICY – AMERICA 250 FOUNDATION

1.   Introduction

Purpose. This Privacy Policy governs the manner in which the America 250 Foundation and its affiliates (“America 250 Foundation”, “Foundation”, “we”, “our”, or “us”) collect, use, maintain, and disclose Personal Information collected when users visit this website at: www.America250.org (or any successor website), and any desktop, subpages, and mobile versions, including all content, materials, features, applications, functionality, products, and services, made available on this website or other platforms (“the Sites”). This Privacy Policy also applies when you interact with us offline. For example, if you provide your contact information to us or interact with us at an America 250 event, this Privacy Policy applies.

The Foundation is a 501(c)(3) nonprofit charitable organization with the sole purpose of supporting the activities of the U.S. Semiquincentennial Commission (“the Commission”).

Personal Information. “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household. We do not consider Personal Information to include information that has been aggregated or de-identified so that it does not allow a third party to easily identify a specific individual.

Acceptance. Please read this Privacy Policy carefully so that you understand our privacy practices. By providing Personal Information to us or by using the Sites, you acknowledge that you agree to be bound and abide by Privacy Policy and the Terms of Service, and you are consenting to the collection, use, and disclosure of that information in accordance with this Privacy Policy.

Part of the Terms of Service.  This Privacy Policy forms part of our Terms of Service at:  www.America250.org/Terms.  Any capitalized, but undefined terms in this Privacy Policy have the meaning given to them in the Terms of Service.

Changes in our Privacy Policy.  We may change this Privacy Policy from time to time, and we may provide you with additional notice through one or more of our channels. We encourage you to review the Privacy Policy whenever you interact with us to stay informed about our information practices.  Any changes will become effective when the revised Privacy Policy is posted on the Site. Your use of the Sites following these changes means that you accept the revised Privacy Policy.  This Policy was last updated March 2, 2020.

2.  Personal Information We Collect

The information we collect falls into two categories: (1) information you voluntarily supply us when you visit our Sites, or otherwise interact with us both online and offline, and submit your information, such as via a contact form or as part of transaction; and (2) tracking information gathered as you visit our Sites. 

Personal Information You Provide

The America 250 Foundation online and offline resources are intended to supply our followers, registered accounts, and the Sites visitors with information about the mission of the U.S. Semiquincentennial Commission and the Foundation. In the course of providing these services, for some materials, services or future monetary, sales, donations, and transactions, you may be asked to provide your name, address, and additional information. The America 250 Foundation will only collect personal information, which you knowingly and voluntarily provide by, for example, sending queries via email, completing forms, or responding to surveys. 

The types of information we collect include

  1. name;
  2. email address;
  3. zip code;
  4. billing address;
  5. shipping address;
  6. phone number;
  7. social media information
  8. payment information; or
  9. demographic information.

 Interactions requiring personal information may include, but are not limited to:

  1. Registering with an account on the Sites;
  2. Donations to, sales from, the America 250 Foundation;
  3. Signing up for email updates and/or newsletters;
  4. Entering a contest exclusively sponsored by the Commission or the Foundation; or
  5. Registering for an event, hearing, or other gathering sponsored by the Commission or the Foundation.

In some cases, we may also collect information you provide about others, such as in giving a future donation or purchasing a future product. We will use this information to fulfill your request and will provide the recipient our standard opportunity to opt out of further marketing communication.

You may use the Sites as a guest and not register or create an account in order to use it to explore our content.  However, not all functionality may be available to you as a user or account holder on the Sites.

Passive Information Collection

We may use analytics tools, including third party services such as Google Analytics, to help us measure traffic, usage, and sales trends by your use of our Sites. These tools use various technologies, including cookies or similar technologies, to collect certain information sent by your devices to the Site, including:

  1. Your browser name,
  2. The pages you visit on the Sites,
  3. Whether you have previously accessed the Sites,
  4. The IP (Internet Protocol) address for your computer
  5. The type of computer and technical information about your means of connection to our Sites, such as the operating system and the Internet service providers utilized, and
  6. Navigational Data, also known as log files, server logs or clickstream data.

We conduct the passive collection of the above information in a variety of ways, including:

  1. Through your browser or device. Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language and Internet browser type and version. We use this information to ensure that the Sites and its services function properly.
  2. Through your use of the Sites. When you visit the Sites, we may track and collect the usage data, including but not limited to the date and time your device accessed the Sites.       
  3. Using cookies. Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Sites, pages visited, language preferences, and other traffic data of the Sites. We use the information for security purposes, to facilitate navigation and display information more effectively. We can recognize your computer to assist your use of the Sites.

    If you do not want information collected through the use of cookies, you may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent.  However, if you do not accept these cookies, you may experience some inconveniences in your use of the Sites and some parts of the Sites may not function properly.

  4. Using tracking technologies. We may use tracking technologies to track you across third-party websites. We do not currently respond to “do not track” signals or other mechanisms that might enable users to opt out of tracking on the Sites.

  5. Using pixel tags and other similar technologies. Pixel tags (also known as web beacons and clear GIFs) may be used in connection with the Sites to, among other things, track the actions of users of the Sites to improve the Sites and its associated services.

  6. Using your IP Address. Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. An IP Address may be identified and logged automatically in our server log files whenever you access the Sites, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice and is done automatically by many websites, applications and other services. We may use IP Addresses for purposes such as calculating usage levels of the Sites, helping diagnose server problems, and administering the Sites and its associated services. We may block certain IP addresses if they attempt to access the administrative portions of the site without authorization.

3.  How We Use Information

We use information about you for various purposes, including to:

  1. Provide the services you request, process future transactions and send you related information, including any confirmations and receipts;Respond to your comments, questions and requests;
  2. Communicate with you about the Foundation, including our events, news and information we think will be of interest to you.
  3. Personalize your online experience;
  4. Monitor and analyze trends, usage and activities; and
  5. Comply with our legal and regulatory obligations, including to enforce our Terms of Use, prevent or respond to fraud, and fulfill other legal obligations; and
  6. Carry out any other purpose for which the information was collected, consistent with the commitments made in this Privacy Policy. 

From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy. If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.

4How We Share Information

We do not sell, trade, or rent your Personal Information to others.

We may share the categories of personal information described above with service providers and third parties that we partner with to assist us in various functions, including providing technological support and performing security and anti-fraud services, providing you with our services and products, and providing you with communications and marketing information on our behalf. These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use your Personal Information for any other purpose.

These service providers and third parties can be classified in the following categories:

  1. Financial partners involved in the processing of your banking or credit card data in retail locations;
  2. Marketing partners, which we use to send you promotional communications, for instance;
  3. IT service providers, such as our data hosting provider and companies we employ to manage our Sites and to provide Sites-related services and/or to assist us in analyzing how our Sites are used; or
  4. Other service providers that we may engage to provide services to us or on our behalf

Your Personal Information may be disclosed to a third party if we are required to do so because of an applicable law, court order or governmental regulation, or if such disclosure is otherwise necessary in support of any criminal or other legal investigation or proceeding. Your Personal Information may be disclosed to a third party if the disclosure is reasonably related to the potential or actual sale or other disposition of all or part of our business or assets.

We may share aggregated or de-identified information with third-party partners, affiliates, or service providers for the purposes outlined above.

We may use third-party services such as Google Analytics to collect, monitor and analyze information as described above. Those third-party service providers have their own privacy policies addressing how they use such information. 5.  Information Retention

We will retain your Personal Information for as long as your Sites account is active, as needed to provide you with services,  and as necessary to comply with our legal obligations, resolve disputes, defend our legal rights, and enforce our agreements.

6.  Social Media

The Sites may use social plug-ins which are provided and operated by third-party social networking sites, such as Facebook’s Like Button or account creation using your social media account information. As a result of this, you may send to the third-party social networking site the information that you are viewing on a certain part of the Sites.

7.  How We Protect Your Information 

We take the protection of our users' personal information very seriously We seek to use commercially-reasonable data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personal Information under our control, in accordance with this Privacy Policy. However, the Internet is not 100% secure or error free. We cannot guarantee that your use of our Site will be completely safe, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.  We encourage you to use caution when using the Internet.

By using the Sites or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Sites. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Site or sending an email to you. You may have a legal right to receive this notice in writing. If you have any questions or concerns, please notify us at info@america250.org.

The safety and security of your information also depends on you. Where you have chosen an account password for access to certain features of the Sites, you are responsible for keeping this password confidential. We ask that you not share your password with anyone and encourage you not to use the same password on the Sites as you use on other websites. If you have created an account or have logged onto the Sites via your social networking site account (such as through your Facebook account), you are responsible for maintaining the security of your login credentials in accordance with the instructions and policies of the relevant social networking website.

8.  Children and Privacy

We do not knowingly permit children under age 13 (in the United States) without adult supervision as described in our Terms of Service or age 16 (in the European Economic Area (EEA) to register and/or to create an account for any content, product, or service.  We will not knowingly collect, use, or disclose personally identifiable information about people under age 13 (in the United States) or age 16 (in the EEA), except as permitted by law. If we learn that we have collected any Personal Information from anyone under age 13 (in the United States) or age 16 (in the EEA), we will promptly take steps to delete such information.

9.  Links to Third-Party Sites

While the America 250 Foundation is highly selective about which websites we provide links to or from our Sites, we do not control those websites. We encourage you to review the privacy policies posted on these third-party sites, as these policies will govern treatment of your personal information on those websites.

10.   Privacy Rights

Nevada Privacy Rights

We do not sell personal information for monetary consideration.  Nevada residents have the right to submit a verified request directing us not to sell their personal information. California Shine the Light Law

GTI does not share Personal Information (as defined by California Civil Code §1798.83) with other people or non-affiliated businesses for their direct marketing purposes.

California Consumer Privacy Act

The California Privacy Protection Act, which became effective January 1, 2020 (“CCPA”) is applicable to “for-profit” businesses receiving personal information of California consumers and provides California consumers with certain rights regarding the collection and treatment of their personal information. While not a “for profit” business subject to CCPA, The America 250 Foundation takes your privacy seriously and our privacy practices are designed to protect your information. In addition, and for added clarity, while we may disclose personal information for the purposes outlined in this Privacy Policy, we do not sell the personal information of individuals. Please review the remainder of our Privacy Policy for additional information regarding our practices.

11.  Governing Law

Should any dispute or controversy arise out of or relating to these Terms of Use, the Privacy Policy or the Website provided by the Foundation, it shall be subject to the jurisdiction and venue of State and Federal Courts in the Commonwealth of Pennsylvania, and shall be governed by the laws of the Commonwealth of Pennsylvania without regard to its conflict of law provisions.
